These Terms and Conditions govern the use of the My African Shop website and the purchase of products from us. By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms and Conditions.


1. ABOUT US

My African Shop (“we”, “our”, “us”) is an online retailer specialising in African groceries, food products, beverages, fresh produce, frozen foods, household products, personal care products, and related goods.


2. PLACING AN ORDER

2.1 Order Acceptance

All orders are subject to acceptance and product availability.

An order confirmation email acknowledges receipt of your order but does not constitute acceptance. Acceptance occurs when your order has been dispatched.

2.2 Order Cancellation

We reserve the right to refuse, cancel, or limit any order where:

  • Products are unavailable;

  • A pricing or product information error has occurred;

  • Fraudulent or suspicious activity is suspected;

  • We are unable to verify payment information; or

  • We reasonably believe the order breaches these Terms and Conditions.

Customers are responsible for ensuring that all information provided during checkout, including delivery address, telephone number, and email address, is accurate and complete.

My African Shop shall not be responsible for failed deliveries, delays, or additional costs resulting from incorrect information supplied by the customer.


3. PRODUCTS

3.1 Product Information

We make reasonable efforts to ensure that product descriptions, images, ingredients, weights, sizes, and prices displayed on our website are accurate.

However:

  • Product packaging may differ from images shown online;

  • Manufacturers may change ingredients, packaging, specifications, or labelling without notice;

  • Colours displayed on screens may vary from actual products;

  • Product availability may change without notice.

3.2 Product Availability

All products are subject to availability.

Where a product becomes unavailable after an order has been placed, we may:

  • Offer a suitable substitute;

  • Partially fulfil the order and refund the unavailable item(s); or

  • Provide a full refund where appropriate.


4. PRICES AND PAYMENT

4.1 Pricing

All prices displayed on our website are in Pounds Sterling (£) and include VAT where applicable.

We reserve the right to amend prices at any time without notice. Any changes will not affect orders that have already been accepted.

4.2 Payment

Payment must be received in full before goods are dispatched.

We accept payment through the payment methods available on our website at the time of purchase.


5. DELIVERY

5.1 Delivery Areas

My African Shop currently delivers to addresses within mainland United Kingdom.

We do not currently deliver to the Isle of Man.

We reserve the right to amend or restrict delivery areas at any time.

5.2 Delivery Times

Our standard delivery timeframe is between 5 and 10 working days from the date an order is processed and dispatched.

Delivery times are estimates only and are not guaranteed.

We shall not be liable for delays caused by circumstances beyond our reasonable control, including:

  • Courier delays;

  • Severe weather conditions;

  • Road closures or transport disruptions;

  • Customs or border inspections;

  • Industrial action;

  • Public holidays; or

  • Any other unforeseen events.

5.3 Delivery Responsibilities

Customers are responsible for ensuring that:

  • The delivery address provided is accurate;

  • Someone is available to receive the order where required; and

  • Goods are inspected promptly upon delivery.

Risk in the goods passes to the customer upon successful delivery to the delivery address provided during checkout.

Ownership of goods remains with My African Shop until full payment has been received.


6. INSPECTION OF GOODS AND DELIVERY ISSUES

Customers should inspect all goods immediately upon delivery.

Any shortages, missing items, incorrect products, damaged packaging, damaged products, or delivery-related issues must be reported to My African Shop within 48 hours of delivery.

Claims submitted after this period may be declined where the delay prevents us from conducting a proper investigation.

To assist with investigations, customers may be required to provide:

  • Clear photographs of affected products;

  • Photographs of external packaging;

  • Order details;

  • Delivery information; and

  • Any other information reasonably requested.

Failure to provide sufficient supporting evidence may result in a claim being declined.


7. RETURNS AND REFUNDS

7.1 Consumer Rights

Nothing in these Terms and Conditions affects your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

7.2 Non-Returnable Products

Due to hygiene, food safety, and product integrity requirements, the following items are non-returnable unless they are faulty, incorrectly supplied, or otherwise required by law:

  • Fresh fruits and vegetables;

  • Fresh meat, poultry, and fish products;

  • Frozen foods;

  • Refrigerated products;

  • Perishable food items;

  • Opened food products;

  • Opened beverages;

  • Opened personal care and beauty products;

  • Products with broken safety, hygiene, or tamper-evident seals;

  • Special-order items;

  • Customised or personalised products.

7.3 Glass Bottles and Liquid Products

Many traditional African beverages, sauces, oils, and other products sold by My African Shop are packaged in glass bottles or liquid containers.

While we take reasonable care to package these products securely, customers acknowledge that such products carry an increased risk of damage during transportation.

Customers must inspect these products immediately upon delivery and report any issues within 48 hours.

As our third-party delivery partners do not provide compensation for damage to glass bottles or liquid contents during transit, My African Shop cannot guarantee refunds, replacements, or compensation for damage affecting glass-bottled drinks or liquid products during delivery.

However, all claims will be reviewed on a case-by-case basis, and we may, at our discretion, offer a goodwill replacement, store credit, or other appropriate resolution where circumstances warrant.

Nothing in this clause affects your statutory rights under applicable consumer protection laws.

7.4 Incorrect Orders

Where My African Shop has supplied an incorrect item, we will investigate the matter and, where appropriate, provide:

  • A replacement item;

  • A refund;

  • Store credit; or

  • Another suitable remedy.

7.5 Refund Processing

Approved refunds will be issued using the original payment method where possible.

Refund processing times may vary depending on the payment provider and financial institution involved.


8. CLAIMS PROCESS

To assist us in resolving claims efficiently, customers may be asked to provide:

  • Photographs of damaged goods;

  • Photographs of packaging;

  • Delivery confirmation details;

  • Order information; and

  • Any other information reasonably required to assess the claim.

We reserve the right to investigate all claims before approving refunds, replacements, or credits.


9. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation; or

  • Breach of statutory consumer rights.

Subject to the above, our total liability shall not exceed the value of the products purchased.

We shall not be liable for indirect, incidental, special, or consequential losses, including loss of profits, business interruption, loss of opportunity, or loss of goodwill.


10. FORCE MAJEURE

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including:

  • Natural disasters;

  • Floods;

  • Fires;

  • Epidemics or pandemics;

  • Government actions or restrictions;

  • Transport disruptions;

  • Industrial disputes; or

  • Failures of third-party service providers.


11. PRIVACY

Any personal information collected through our website will be processed in accordance with our Privacy Policy and applicable UK data protection legislation.


12. GOVERNING LAW

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
